Notarial Services

We live in a globalised world where it is becoming increasingly necessary, when opening bank accounts, applying for travel documents or doing business generally, to prove our identity, place of residence as a minimum and often other things such as proof of employment income, capital and so on.

In these situations, we cannot risk releasing original documents for fear of them getting lost so most institutions will accept copies of important documents which are certified as true copies by Notaries.

Notaries are lawyers with the appropriate qualifications or other professionals and officials who have the standing to certify these important documents.

 

How can we help:

  • Our Law Team has a number of qualifying lawyers or Notaries who can see you at short notice and sometimes without a prearranged appointment, in urgent cases.
  • Our notaries will examine your original documents and your photo ID or passport to establish your ID and then proceed to copy the required documents and certify them to be true copies (i.e. Notarise your documents). These Notarised copy documents can then be relied upon for the vast majority of ‘official’ purposes.
  • Sometimes you may be required to sign an evidential document such as a statutory declaration of affidavit and have your signature witnessed by an independent professional such as a Notary.
  • Our Notary will charge a competitive fixed fee per document and half of that fixed fee for each exhibit.

Consumer Protection Law

In today’s world, we are all, as individuals, consumers of a huge number of goods and services. Most goods and services these days are of an adequate standard but there are always those who will ‘cut corners’ for an extra profit.

Consumers are offered protection under Thai Consumer Protection Laws but how many of them know what their rights are and how to go about enforcing those rights?

Consumer protection rights in general:

Consumer Protection Laws, as the name suggests, are designed to protect consumers in the event that they receive substandard or dangerous products or services. Many consumers are not aware of their rights in such situations and may not be aware of the extent to which they are protected.

How can we help:

A member of our law team specializing in Consumer protection Law can provide advice, represent clients in negotiating with the supplier of the substandard products and, if necessary, take legal action to obtain compensation, for you. Putting your financial affairs in order:

The only sure things in life are death and taxes’. None of us have control over these two certainties but we can take steps to ensure that most of our hard-earned wealth passes smoothly to our loved oneswhen we die and minimise the tax paid by our estate, so far as the law allows.

The first step is to write a legally binding and enforceable last will and testament and keep it under review either when your financial circumstances change or around every three years, whichever comes sooner.

A Will is the best way to ensure that your estate is distributed in accordance with your wishes in a tax efficient manner. It also allows you to select your Executors (professionals like Orion or friends/family members you trust), appoint Guardians and Trustees for any non-adult children who survive you, stipulate at what age you would like your children to inherit and even your instructions regarding your funeral arrangements. If you die without leaving a Will these important issues will be left in the hands of others to decide and your estate will be distributed in accordance with the Thai laws of Intestacy which are current at the date of your death. For peace of mind, you should make sure that you have a valid Will in place.

When things go wrong:

Contract disputes arise when one party to a contract (for goods or services) does not perform his/her or its obligations under the contract or when there is a difference in opinion over the interpretation of the contract terms. The most common types of contractual dispute occur over sale or hire of property, goods or services; loans and mortgages; partnerships and joint ventures and agency or brokerages agreements but there are many more types of contracts.

When contractual disputes occur, the parties in dispute have a number of options to resolve the dispute. The first option which is usually explored is to resolve the dispute through negotiation. If negotiations are not successful then the parties may either decide to take their dispute to a mediator, an arbitrator or to court. Mediation and arbitration are generally quicker and cheaper options than going to court.

Mediation and arbitration are similar processes except that in arbitration both parties contractually agree to be bound to the decision of the arbitrator whereas in mediation they do not agree to be boundby the mediator’s decision but the mediator will make his/her best efforts to help the parties reach a settlement.

In both mediation and arbitration, the disputing parties will identify and agree upon a mediator / arbitrator who will then examine the details of the case including the evidence and the relevant contracts and laws. As well as being cheaper and quicker than legal proceedings, mediation and arbitration are also more confidential and therefore less damaging to the parties’ reputation and offer more protection to the confidential information of the parties, in dispute.

If negotiation, mediation and arbitration are not successful then the wronged party may have no choice but to take legal action to receive compensation. Acts which break a contract and cause damage to a third party may also be wrongful acts under other existing laws. The wronged party must therefore consider whether to take legal action over the breaking of the contract, the nature of the act itself or both.

Trademarks

  • Advise on suitability for registration – Not all marks can be registered. If the mark is not distinctive enough (an everyday object with no defining characteristics) then it will not be accepted by the Trademark Office. Recognizing this at an early stage will save time and allow for necessary changes to be made to allow your mark to be registered.
  • Searching for prior registrations – If your mark is the same as or similar to a mark that has already been registered then it will also not be accepted by the Trademark Office
  • Registration – Once we have confirmed that the mark is suitable to be registered, we can begin the registration process. The total process takes approximately 15 months from start to finish.
